Cancellations…

Cancellations Policy: Once you have placed an order you have entered into a contract, However we understand that cancellations are needed to be made from time to time, our cancellation terms are outlined below and are designed to be very reasonable. The policy is only in place to protect both our and your best interests and ensure that our out of pocket expenses are covered. It is not designed to be profitable on our part;
Orders up to £100: Cancellations are accepted. All we ask is that you cancel the order before 12noon on the friday before your event. Should your order be cancelled after 12noon on the friday before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 50% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not.
Orders between £100 and £200: Cancellations are accepted but must be made at least 7 days in advance of the event in order not to incur a cancellation charge. Cancellations made between 7 days in advance of the event and up until 12noon on the day before your event will be subject to a 15% cancellation fee to cover our costs. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 50% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not.
Orders between £200 and £400: Cancellations are accepted but must be made at least 7 days in advance of the event in order not to incur a cancellation charge. Cancellations made between 7 days in advance of the event and up until 12noon on the day before your event will be subject to a 20% cancellation fee to cover our costs. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 50% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not.
Orders over £400: Unfortunately all orders over the value of £400 are subject to a 25% cancellation charge regardless of when the order or cancellation is made due to the large amount of preparation and event management that will have taken place already that must be recovered. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 50% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not.
Cancellations on arrival due to not fitting: All sizes and dimensions are clearly displayed on our website. Should we arrive on the day and the items not fit in your chosen venue or event area your order will be subject to a 50% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not. No exceptions. We will try our best to provide an alternative or accommodate the relocation of the entertainment, however our event staff will only have a finite amount of time allocated to your booking and must keep a tight schedule in order not disrupt other bookings on that day.
Refusal of delivery: Should our team arrive at your venue and for whatever reason you cancel the booking your order will be subject to a 50% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, fuel costs, vehicle & generator hire and staff commitments which will have to be paid for regardless of weather your event goes ahead or not. The only way in which to avoid a penalty is to provide our delivery team with a copy of your Cancellation Confirmation. Failure to pay on the day will result in your case being presented to Daniel Silverman Ltd as outlined below.
Bulk orders: Cancellation of bulk orders and multiple event date carries a strict 25% cancellation charge on ALL BOOKED EVENTS. This is due to the number of resources and equipment tied up on multiple dates across the year.
Under no circumstances will any refund be given. The 25% charge is a calculation based on a mixture lost revenue from previous examples of bulk cancellations, staff resources and administration already dedicated to your events and lack of availability of items to other clients as a result. This charge is designed to cover our costs and not make a profit from your misfortune.
ALL Cancellations must be made in writing via letter or email regardless of how the entertainment was booked and within the time scales outlined above.

Cancellations left on a voice mail are not acceptable as they may not be picked up until after your event. You must speak with a human being during normal working hours (Mon-Fri, 9am - 5pm). Failure to do so may result in a cancellation charge.

Due to the high number of fraudulent cancellation claims, we must make it fully clear that sending an email or letter to us is not proof of delivery. In the case of email, If no confirmation is received from us within 24hrs & in the case of a letter, no response is received within 10 days, please contact us immediately via telephone to verify your request has been received. If no verification can be proved or cancellation number produced then you will still be charged the appropriate fee as outlined above.

No cancellation is final until we have send you a cancellation notice via email. If you haven't received the email please call us for verification in order to avoid disappointment and charge.

PLEASE NOTE: ALL CANCELLATIONS ARE ISSUED WITH A UNIQUE CANCELLATION NUMBER FOR VERIFICATION PURPOSES. PLEASE KEEP THIS NUMBER SAFE IN THE EVENT THAT YOU BE REQUIRED TO PROVE YOUR CANCELLATION. ANY CANCELLATION CLAIMS MADE WITHOUT A CANCELLATION NUMBER WILL STILL BE SUBJECT TO A CHARGE AS THIS IS THE ONLY PROOF THAT YOU HAVE CANCELLED WITH AN ACTUAL HUMAN BEING. FAILURE TO PRODUCE A CANCELLATION NUMBER IN A DISPUTE WILL RESULT IN A CANCELLATION FEE OF 50%.

Legal Action: *Failure to adhere to the payment terms & conditions will result in your file being passed over to Daniel Silverman Ltd for action. Daniel Silverman (Reg Company number 3998129) are a dedicated debt recovery agent that will act on our behalf to recover any outstanding payments and will represent us in the event of court proceedings taking place. Daniel Silverman Ltd are members of the Credit Services Association (CSA) are Registered with the Data Protection Agency (Reg NoZ08889433) and are licensedby the Consumer Credit Act (Licence No 572341 - Issued by the office of fair trading) Should Daniel Silverman Ltd be instructed to act on our behalf, they will automatically increase the outstanding balance of this invoice by 15%.

DISCLAIMER: Whilst we endeavour to deliver all of our entertainment on time and in good condition, On extremely rare occasion’s things don’t always go as planned due to circumstances out of control.

As you will be aware FunBounce offer an overnight hire service which sometimes requires us to collect items from the previous hire just before delivering it to your venue. In extreme cases we sometimes find that the entertainment is wet or dirty and may have to be wiped over and/or dried out once we reach your venue so please ensure you have allowed plenty of time for us to carry out these duties before your party starts. We usually recommend 2hrs just in case.
In addition to this we very occasionally find that the entertainment has been damaged and unreported by the previous hirer and as such we may have to (without warning) substitute your entertainment for something similar to ensure that we don’t let you down on the day.
Also please note: ALL delivery and collection times are approximate, so again, please ensure you allow plenty of time before your party start & finish time (We usually recommend 2hrs just in case.)
Notwithstanding the above, our staff will work tirelessly until the equipment is satisfactory and endeavour to keep you updated. Should you still not find the equipment to be satisfactory, you still have the right to refuse delivery on the day to request a substitution, however our drivers keep a very tight schedule and all requests must be made prior to the driver leaving site.
In the very rare event that any of the above information should apply to you on the day, there is a comments box on the hire agreement presented to you for a signature on completion of the works. Please either complete this section or refuse the equipment. Any problems reported after an event & not recorded on the hire agreement cannot be dealt with, rectified or refunded so please ensure this is completed.

Definitions

1.1 The "Client" means the person/s, organisation or company booking the equipment, act or entertainment with the "Company".

1.2 The "Company" means Funbounce Entertainments or Betterbounce Direct Ltd.

1.3 'Dry' hire is the hire of equipment for the 'client' to operate and supervise themselves.

1.4 'Wet' hire is the hire of equipment or entertainment accompanied by a representative of the 'company' to supervise use of the booked equipment or entertainment.

Bookings
2.1 All equipment remains the property of the company at all times.

2.2 By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.

2.3 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event on a pro rata reduction in the hire fee in the event of delayed start (based on party start time only). No further compensation will be paid irrespective of any loss of earnings as a result of the hire.

2.4 In the event that you are unhappy with your entertainment on arrival or the time in which it arrived, please contact the office immediately. Do not sign the drivers paperwork without placing your concerns in the comments box at the bottom right hand side of the disclaimer. Once payment has been made and a signature obtained to say that you are happy with the goods on the day, it it impossible for us to negotiate on price afterwards and as such no compensation can be offered.

Prices, Deposit & Balance Payments
3.1 Certain hires are subject to a deposit of at least 50% (Deposit is non refundable).

3.2 The balance to be paid in full and cleared 7 days prior to the event start date unless approved account facilities are held.

3.3 The company do not offer credit of any kind so please don't ask. We have been caught out by a number of larger, so called reliable companies and as such payment terms are strictly in advance or on delivery.

3.4 Advertised prices are subject to change without prior notification.

3.5 The company reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate.

3.6 All prices are subject to VAT at the current rate.

Cancellations

Equipment
5.1 The company reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.

5.2 All sizes quoted are approximate

5.3 All goods remain the property of the company at all times.

5.4 The company reserve the right to amend or alter any product specifications without prior notice.

Site Location, Facilities & Conduct
6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded and erected.

6.2 The company reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.

6.3 The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

6.3 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.

Liability & Insurance
7.1 The company’s liability insurance covers use of the equipment only whilst booked on 'wet' hire (supervised by a representative of the company).

7.2 The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire.

7.3 The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

7.4 Any equipment booked on 'dry hire' is not covered by the company’s insurance policy and the client is responsible for suitable insurance cover.

Refusal of collection
8.1 In the rare event that you are unhappy with your entertainment for whatever reason, there is no valid reason for holding our equipment to ransom. In the event that a customer does hold an item to ransom we will have no option to contact the police. Withholding equipment from is is a criminal offence despite weather or not you are happy with our service.

8.2 In the event that you are unhappy with our services, please contact the office as soon as you can after delivery has been made, either by telephone or by email as problems are much more difficult to resolve after an event has passed.

8.3 Should something drastic happen on our vehicles and in the event we are unable to collect our equipment from your premises you will be informed, however The company will accept no liability or responsibility for loss or damage to property or the surface the inflatable is erected on.
